This Privacy Policy explains how personal data is processed when you visit agentificial.com, contact us or book a call. Agentificial is a brand of Acquificial.

1. Hosting and delivery of this website

This website is hosted by Netlify (USA) and delivered through Cloudflare (USA), which also provides our DNS and security services (CDN, DDoS protection). When you open a page, your browser transmits technical data (IP address, date and time, requested URL, browser and device information) to these providers, which process it to deliver the site and keep it secure. We do not control the server location: the website is not hosted exclusively in the EU, and data may be processed in the USA.

Legal basis: Art. 6(1)(f) GDPR — our legitimate interest in a secure, reliable and fast website. Retention: server and edge logs are kept by the providers for a short period under their own retention settings.

2. Reach measurement (Cloudflare Web Analytics)

We use Cloudflare Web Analytics to measure aggregate traffic (page views, referrers, country, device type). It is designed to work without cookies and without building profiles of individual visitors.

Legal basis: Art. 6(1)(f) GDPR — our legitimate interest in understanding how the site is used.

3. Contacting us by email (Cloudflare Email Routing)

If you email [email protected], the message is forwarded to our mailbox via Cloudflare Email Routing. We process your name, email address and message content to answer your enquiry.

Legal basis: Art. 6(1)(b) GDPR (pre-contractual steps at your request) or Art. 6(1)(f) GDPR (answering general enquiries). Retention: until the enquiry is resolved, plus any statutory retention period (for example commercial correspondence under German tax and commercial law).

4. Booking a call (Calendly)

The home page embeds a booking widget from Calendly (USA). When the widget is loaded, Calendly receives technical data such as your IP address and browser information and may use cookies or similar technologies. If you book a call, you enter your name, email address and any message directly with Calendly, which shares the booking with us and sends confirmation emails. See Calendly's own privacy notice for details.

Legal basis: Art. 6(1)(b) GDPR for the booking itself; Art. 6(1)(f) GDPR for embedding the widget. Where storing or reading information on your device requires consent, that consent is the basis; you can decline, and book by emailing us instead.

5. Meta Pixel (only with your consent)

If you click Accept in the cookie banner, this website loads the Meta Pixel of Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland ("Meta"). The pixel sets cookies and sends Meta information about your visit (pages viewed, browser and device data, IP address and, if you are logged in to Facebook or Instagram, a link to your account). We use it to measure the results of our ads on Facebook and Instagram and to show our ads to people who have visited this website. If you click Decline or make no choice, the pixel is not loaded and no data is sent to Meta.

For collecting and transmitting this data, we and Meta are joint controllers (Art. 26 GDPR); the agreement is available at facebook.com/legal/controller_addendum. Meta's further processing is governed by its own privacy policy at facebook.com/privacy/policy.

6. Instantly visitor identification (only with your consent)

If you click Accept in the cookie banner, this website also loads the Website Visitors tag of Instantly.ai (Instantly Technologies Inc., USA), which uses the identification service RB2B (USA). The tag stores identifiers in your browser and sends Instantly and RB2B information about your visit (pages viewed, browser and device data, IP address) to try to recognise the company, and for visitors from the United States the person, behind the visit, so that we can contact companies that showed interest in our services. If you click Decline or make no choice, the tag is not loaded and no data is sent.

7. Fonts

Fonts on this website are served from our own domain. No fonts are loaded from Google or other third-party servers.

8. Transfers to third countries

Netlify, Cloudflare, Calendly, Instantly and RB2B are based in the USA, and Meta may transfer data to Meta Platforms, Inc. in the USA. Transfers of personal data to them rely on the EU–US Data Privacy Framework (adequacy decision of the European Commission) where the provider is certified under it, and otherwise on Standard Contractual Clauses (Art. 46 GDPR).

9. Recipients

Besides the providers named above, we pass personal data on only where the law requires it or where you have asked us to. We do not sell personal data and do not use it for automated decision-making that produces legal effects concerning you.

10. Your rights

You have the right to access, rectification, erasure, restriction of processing and data portability, and the right to object to processing based on Art. 6(1)(f) GDPR. Where processing is based on consent, you may withdraw it at any time with effect for the future. You also have the right to lodge a complaint with a data-protection supervisory authority.
